Donald Gerald Mullanix, of Lakeside, pleads not guilty to charges of: one count of aggravated theft in the first-degree, (which is a B felony) and three counts of first-degree theft by receiving (which are C felonies).

Donald G. Mullanix was arraigned in Coquille on Tuesday, February 16, 2010 at, 3 pm in Judge Stones’s courtroom.

Mullanix plead not guilty, stating he had retained Jesse Coggins as his attorney.

A plea date has been scheduled for March 23, at 8:30 pm in Coquille. This gives time for negotiations with the prosecuting attorney. If an agreement is not reached it will be set for trial.

Own recognizance

According to State Courts in Coquille, Mullanix was released on his own recognizance. The conditions are that he not associate with a long list of names, including that of his grandson, Bradley Mullanix, of Hauser.

Maximum sentencing?

Lakesideinfo.com contacted the Coos County, Assistant District Attorney, to get an idea of the maximum sentence allowable for the assigned felonies.

The maximum sentence for a (B) felony is ten years in jail and the maximum for a (C) felony is five years in jail.

Assistant District Attorney, Oubohn White stated, “sentencing is subject to felony sentencing guidelines, which could be much less.” White further stated, “the guidelines depend on what the Oregon legislature has appointed to any specific crime, taking into consideration the seriousness of the crime and criminal history.

The charges are a result of the burglary and theft investigations conducted by multiple state and county law enforcement agencies in Coos County, January 2010.
